Robert M. McGill to travel to Hungary to coach Boston College Law School's European Law Moot Court Team
Robert M. McGill, an Associate of Sherin and Lodgen LLP, will be traveling to Pécs, Hungary from February 15th – February 18th as coach of Boston College Law School's European Law Moot Court Team. The team's brief was selected as one of the top 48 submitted worldwide, leading to an invitation to argue at the Regional Final in Hungary. The competition will take place over three days and arguments will be conducted in both French and English. If successful in Hungary, the team will argue before the European Court of Justice in Luxembourg in April.

New Massachusetts Health Insurance Law: Important Information for Small Businesses
Chapter 58 of the Acts of 2006, signed into law in April, creates significant new obligations for certain employers who neither provide nor contribute a reasonable amount to their employees’ health insurance. As of October 1, 2006, such employers with eleven or more full-time-equivalent (“FTE”) employees are required to contribute a maximum of $295 per employee per year, known as the “Fair Share Contribution,” to the Commonwealth Care Trust Fund. Revenues generated by employers’ Fair Share Contributions will be used by the Commonwealth to defray costs of providing “free care” to employees. Click here to read more.

Robert J. Muldoon was recently recognized for 24 years of service and achievements as a member and chair of the Massachusetts Board of Bar Examiners by Supreme Judicial Court Chief Justice, Margaret H. Marshall at the John Adams Courthouse. Accompanying the Chief Justice was a panel of distinguished judges, lawyers and media representatives speaking at this year's Bench-Bar Symposium hosted by the Massachusetts Bar Association. This year's topic was "Supporting and Protecting the Independence of the Judiciary."

Abbott Homes Fund I closes $1,250,000 line of credit from HCReit
Sherin and Lodgen LLP recently closed a $1,250,000 line of credit for its client, Abbott Homes Fund I, an affiliate of Abbot Real Estate Development, LLC. The line was granted by HCReit, a national REIT that specializes in health care related real estate. HCReit has committed $100 million to our client for the development of age-restricted residential projects in New England. Frank J. Bailey was recently elected as a member of the board of directors of the Immigrant Learning Center, Inc. The Immigrant Learning Center, Inc. (ILC) is a not-for-profit adult education center located in Malden, MA.

In Lena A. Humphrey v. Florence Byron, SJC adopted the position advocated by Sherin and Lodgen LLP in its amicus brief.

On July 21, 2006, in the case of Lena A. Humphrey v. Florence Byron, the Massachusetts Supreme Judicial Court held that a commercial landlord does not have a duty to maintain leased premises in a "safe condition" unless he expressly undertakes to do so in the lease.

Edward S. Cheng of our firm (with the advice and participation of Edward M. Bloom) filed an amicus brief on behalf of the Massachusetts Defense Lawyers Association which advocated for the result adopted by the SJC.

Sherin and Lodgen LLP recently represented Jackson National Life Insurance Company in closing a $105,450,000 mortgage portfolio loan to Cabot Industrial Value Fund II Operating Partnership, L.P. The loan was secured by industrial properties in five states. Andrew Royce advised Jackson National on this transaction.

RMS Secures Largest Timberland Purchase In History
We congratulate an investor group led by our client, Resource Management Service, LLC, based in Birmingham, AL, on its agreement to buy 4.2 million acres of timberland from International Paper Company in a transaction valued at $5 billion. The deal represents the largest purchase of forest land in history, involving a combined area larger than Massachusetts. RMS is a leading timber investment management firm, with institutional and individual clients throughout North America.

Renewed Concerns About Privacy
The recent inadvertent disclosure of customer confidential information by the Boston Globe highlights the need for companies, schools, non-profits and others who maintain confidential information of their customers, students, donors or for third parties to re-evaluate their privacy and security policies. As was evident, anyone who maintains confidential information must focus on both technology controls (limiting access to confidential information, limiting print outs of credit card information to last 4 digits, etc.), as well as policies for personnel to follow with respect to confidential information (for example, shredding confidential information before disposing of it). Judicial Review of Arbitration Awards
Frank J. Bailey has written an article for the January newsletter of the Business Litigation Section of the International Association of Defense Counsel (IADC). The article explores the scope of judicial review of arbitration awards and recent developments which may alter the scope of that review. The article focuses on a recent case from the First Circuit Court of Appeals. According to the IADC "[T]his is important reading at a time when more business disputes are being resolved through alternatives to litigation."

Supreme Court Expands Liability
