McHenry<\/em>\u2014formerly,\u00a0<em>Texas Top Cop Shop v. Garland<\/em><em>)<\/em>.<\/p>\n<p>On Friday, January 24th, 2025, FinCEN- the agency tasked with enforcing the law- announced that in light of another nationwide stay on implementing the law issued by a different federal judge in Texas (<em>Smith v. U.S. Department of the Treasury<\/em>), reporting companies are still not currently required to file beneficial ownership information with FinCEN despite the Supreme Court\u2019s action in Texas Top Cop Shop. Reporting companies also are not subject to liability if they fail to file this information while the Smith order remains in force.
