{"id":12,"date":"2016-02-23T22:04:07","date_gmt":"2016-02-23T22:04:07","guid":{"rendered":"https:\/\/www.sherin.com\/employment-blog\/?p=12"},"modified":"2021-06-10T20:05:49","modified_gmt":"2021-06-10T20:05:49","slug":"lady-murderface-and-protected-activity-under-the-nlra","status":"publish","type":"post","link":"https:\/\/www.sherin.com\/employment-blog\/2016\/02\/23\/lady-murderface-and-protected-activity-under-the-nlra\/","title":{"rendered":"Lady Murderface and Protected Activity Under the NLRA"},"content":{"rendered":"<p>Have you seen the story about \u201cTalia Jane\u201d?\u00a0 I am not sure what qualifies as \u201cgoing viral\u201d (although I bet my kids do), but since I heard about it, this story may indeed be \u201cviral.\u201d\u00a0<span class=\"Apple-converted-space\">\u00a0<\/span><u>See, e.g.<\/u>,<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"http:\/\/www.businessinsider.com\/talia-jane-fired-yelp-eat24-2-2016\">Here<\/a><span class=\"Apple-converted-space\">\u00a0<\/span>and<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"http:\/\/qz.com\/621182\/i-cant-afford-to-buy-groceries-yelp-fired-an-employee-after-her-scathing-open-letter-to-the-ceo\/?utm_source=YPL\">here<\/a>.<\/p>\n<p>In a nutshell, Talia used to be a customer-service agent at Yelp.\u00a0 On February 19, she published a very lengthy \u201c<a href=\"https:\/\/medium.com\/@taliajane\/an-open-letter-to-my-ceo-fb73df021e7a#.xbbhglf3q\">open letter<\/a>\u201d to Yelp\u2019s CEO on a blog.\u00a0In her blog post, Talia Jane complains about how she and her fellow low-level employees are struggling to make ends meet.<\/p>\n<blockquote><p>So here I am, 25-years old, balancing all sorts of debt and trying to pave a life for myself that doesn\u2019t involve crying in the bathtub every week. Every single one of my coworkers is struggling. They\u2019re taking side jobs, they\u2019re living at home. One of them started a GoFundMe because she couldn\u2019t pay her rent. She ended up leaving the company and moving east, somewhere the minimum wage could double as a living wage.<\/p><\/blockquote>\n<p>The post is as much a commentary about the inadequate minimum wage in San Francisco (and its high cost of living) as it is a complaint about her (perceived inadequate) pay at Yelp.\u00a0 Her post is full of snark. (For example, Talia Jane writes:\u00a0 \u201cAccording to\u00a0<a href=\"http:\/\/virtualglobetrotting.com\/map\/jeremy-stoppelmans-house\/view\/google\/\">this website<\/a>, you\u2019ve got a pretty nice house in the east bay. Have\u00a0<em>you\u00a0<\/em>ever been stranded inside a CVS because you can\u2019t afford to get to work? How much do you pay your gardeners to keep that lawn and lovely backyard looking so neat?\u201d)<\/p>\n<p>She was fired later that day, although Yelp is not publicly saying why. Assuming the reason for her termination was the blog post, does Talia Jane have a claim that under the National Labor Relations Act (NLRA) that she was engaging in protected activity?<\/p>\n<p>As the National Labor Relations Board (NLRB) states on its<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"https:\/\/www.nlrb.gov\/rights-we-protect\/protected-concerted-activity\">website<\/a>, the NLRA \u201cgives employees the right to act together to try to improve their pay and working conditions, with or without a union. If employees are fired, suspended, or otherwise penalized for taking part in protected group activity, the National Labor Relations Board will fight to restore what was unlawfully taken away.\u201d<\/p>\n<p>Again, from the NLRB website, the inquiry will involve three questions:<\/p>\n<blockquote><p><span style=\"color: #003366\"><strong>Is the activity concerted?<\/strong><\/span><\/p>\n<p>Generally, this requires two or more employees acting together to improve wages or working conditions, but the action of a single employee may be considered concerted if he or she involves co-workers before acting, or acts on behalf of others.<\/p>\n<p><span style=\"color: #003366\"><strong>Does it seek to benefit other employees?<\/strong><\/span><\/p>\n<p>Will the improvements sought \u2013 whether in pay, hours, safety, workload, or other terms of employment \u2013 benefit more than just the employee taking action? \u00a0Or is the action more along the lines of a personal gripe, which is not protected?<\/p>\n<p><span style=\"color: #003366\"><strong>Is it carried out in a way that causes it to lose protection?<\/strong><\/span><\/p>\n<p>Reckless or malicious behavior, such as sabotaging equipment, threatening violence, spreading lies about a product, or revealing trade secrets, may cause concerted activity to lose its protection.<\/p><\/blockquote>\n<p>Since 2011, the NLRB has dedicated much time to addressing companies\u2019 social media policies in the non-union context.\u00a0 For the most part, it has expanded the definition of concerted activity in social media.\u00a0<span class=\"Apple-converted-space\">\u00a0<\/span><u>See, e.g.<\/u>,<span class=\"Apple-converted-space\">\u00a0<\/span><u>Hispanics United of Buffalo, Inc. v Carlos Ortiz<\/u>, NLRB No. 3-CA-27872 (Sept. 2, 2011), aff\u2019d 359 NLRB No. 37 (Dec. 14, 2012) (holding that five employees engaged in protected concerted activity by posting Facebook comments that responded to a co-worker\u2019s criticism of their job performance);<span class=\"Apple-converted-space\">\u00a0<\/span><u>Costco Wholesale Corp.<\/u>, 358 NLRB No. 106 (Sept. 7, 2012) (invalidating a company\u2019s electronic posting policy that prohibited employees from making statements that \u201cdamage the Company\u2026or damage any person\u2019s reputation,\u201d because it could chill employees\u2019 willingness to engage in their right of concerted activity);<span class=\"Apple-converted-space\">\u00a0<\/span><u>Three D, LLC v. N.L.R.B.<\/u>, No. 14-3284 (2d Cir. Oct. 21, 2015) (holding that employees\u2019 endorsement of former employee\u2019s claim on social networking website that employer had erred in tax withholding was concerted activity protected by NLRA). \u00a0Still, employers may discipline or even terminate employees for<span class=\"Apple-converted-space\">\u00a0<\/span><em>personal<\/em><span class=\"Apple-converted-space\">\u00a0<\/span>rants and insults on social media that do not engage other employees.<\/p>\n<p>Talia Jane knew that her post might cost her job.\u00a0 (After she tweeted her blog post to the world \u2013 from her \u201cLady Murderface\u201d twitter handle \u2013 she followed up with this tweet: \u00a0\u201cmight lose my job for this so it\u2019d be cool if u shared so i could go out in a blaze of\u2026..people knowing why i got fired?\u201d)\u00a0 In fact, given Lady Murderface\u2019s expressed desire to work in media, I think it is a safe bet she wanted to get fired.<\/p>\n<p>But back to the question at hand: what happens if Talia Jane makes a claim against Yelp?\u00a0 Although we don\u2019t know all the facts, it could be a close call.<\/p>\n<p><strong><span style=\"color: #003366\">Is the activity concerted?<\/span>\u00a0<\/strong>On the one hand, there was no \u201cconcerted activity.\u201d\u00a0 Talia Jane was acting alone.\u00a0 On the other hand, Talia Jane<span class=\"Apple-converted-space\">\u00a0<\/span><em>arguably<\/em><span class=\"Apple-converted-space\">\u00a0<\/span>was acting not only on her own behalf but other low-level Yelp workers struggling to make ends meet.<\/p>\n<p><strong><span style=\"color: #003366\">Does it seek to benefit other employees?<\/span>\u00a0<\/strong>To the extent she is advocating for higher pay generally, yes.<\/p>\n<p><strong><span style=\"color: #003366\">Is it carried out in a way that causes it to lose protection?<\/span>\u00a0<\/strong>If the answer to the first question does not doom her, Talia Jane could run into problems here.\u00a0 While ranting about the lack of training, poor retention, and inadequate pay, Talia Jane writes:<\/p>\n<blockquote><p>Speaking of that whole training thing, do you know what the average retention rate of your lowest employees (like myself) are? Because I haven\u2019t been here very long, but it seems like every week the faces change. \u2026\u00a0 Do you know how many cash coupons I used to give out before I was properly trained? In one month, I gave out over $600 to customers for a variety of issues. Now, since getting more training, I\u2019ve given out about $15 in the past three months because I\u2019ve been able to de-escalate messed up situations using just my customer service skills. Do you think that\u2019s coincidence? Or is the goal to have these free bleeders who throw money at angry customers to calm them down set the standard for the whole company?<\/p><\/blockquote>\n<p>I have never called Yelp to complain, but if I ever do, I guess I should look for a cash coupon.\u00a0 Who knew Yelp\u2019s customer-service team was full of \u201cfree bleeders [who] throw money at angry customers\u201d?<\/p>\n<p>My hunch is that Talia Jane won\u2019t make a claim \u2014 I doubt she wants her job restored \u2014 and instead will ride this wave of publicity to a job she finds more satisfying.\u00a0 Nevertheless, this case serves as an important reminder regarding the potential landmines that social media presents to employers.\u00a0 Employers and their counsel should approach disciplinary decisions involving social media with caution, and should make sure that any decisions focus on activity that is not protected under the NLRA.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Have you seen the story about \u201cTalia Jane\u201d?\u00a0 I am not sure what qualifies as \u201cgoing viral\u201d (although I bet my kids do), but since I heard about it, this story may indeed be \u201cviral.\u201d\u00a0\u00a0See, e.g.,\u00a0Here\u00a0and\u00a0here.
