{"id":124,"date":"2018-04-30T20:41:15","date_gmt":"2018-04-30T20:41:15","guid":{"rendered":"https:\/\/www.sherin.com\/employment-blog\/?p=124"},"modified":"2021-06-10T19:10:37","modified_gmt":"2021-06-10T19:10:37","slug":"legal-alert-updated-equal-pay-act-effective-july-1-2018","status":"publish","type":"post","link":"https:\/\/www.sherin.com\/employment-blog\/2018\/04\/30\/legal-alert-updated-equal-pay-act-effective-july-1-2018\/","title":{"rendered":"LEGAL ALERT: Updated Equal Pay Act, Effective July 1, 2018"},"content":{"rendered":"<p>On July 1, 2018, the new Massachusetts Equal Pay Act takes effect.\u00a0 The Office of the Attorney General has published an overview of the new law and answers to frequently asked questions which is available, <strong><a href=\"https:\/\/www.mass.gov\/files\/documents\/2018\/03\/01\/AGO%20Equal%20Pay%20Act%20Guidance.pdf\">here<\/a>.<\/strong><\/p>\n<p>The Act updates and replaces M.G.L. c. 149, Section 105A.\u00a0 Some key provisions of the Act are the following:<\/p>\n<ol>\n<li>Employers may not prohibit employees from discussing their wages<\/li>\n<li>Employers may not require prospective employees to disclose their wage or salary history<\/li>\n<li>Employers may pay different wages to men and women doing comparable work based only on one or more of six specified factors (seniority, merit, production \/ sales, geographic location, education\/ training \/ experience, and\/or travel requirements).<\/li>\n<\/ol>\n<p>In some circumstances, an employer that undertakes a good faith, reasonable self-evaluation and is making reasonable progress eliminating unlawful gender-based wage differentials may have an affirmative defense.<\/p>\n<p>Comparable work is work requiring substantially similar skill, effort and responsibility, and is performed under similar working conditions.\u00a0 What is or is not similar may require a case-by-case determination, as will, e.g., relative merit.\u00a0 Needless to say, employees and employers will continue to spar over whether such determinations were unlawfully biased and whether efforts to eliminate unlawful disparities were reasonable, undertaken in good faith and timely.\u00a0 Standby for more!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On July 1, 2018, the new Massachusetts Equal Pay Act takes effect.\u00a0 The Office of the Attorney General has published an overview of the new law and answers to frequently asked questions which is available, here.
