The article, \u201c3 Discrimination Takeaways From The Latest High Court Term,\u201d covered lessons for workplace bias law practitioners to glean from the latest Supreme Court Term, which ended last Thursday.<\/p>\n<p><a href=\"https:\/\/www.law360.com\/employment-authority\/discrimination\/articles\/1399612\/3-discrimination-takeaways-from-the-latest-high-court-term?nl_pk=5b6011fc-fa7d-4c55-ae2b-896811f5020f&amp;utm_source=newsletter&amp;utm_medium=email&amp;utm_campaign=employment-authority\/discrimination&amp;read_more=1\" target=\"_blank\" rel=\"noopener\">Read the full article in\u00a0<em>Law360<\/em>\u00a0(subscriber content)<\/a>.<\/p>\n<p><em>Gavi\u2019s quotes from the article:<\/em><\/p>\n<p>\u201c\u2019There were a couple of cases this term that, while they weren\u2019t specifically employment discrimination cases, I do think they have implications for the work that my colleagues and I do,\u2019 said Gavriela Bogin-Farber, an attorney at\u00a0<a href=\"https:\/\/www.law360.com\/firms\/sherin-lodgen\">Sherin and Lodgen LLP\u2019s Boston<\/a>\u00a0office.<\/p>\n<p>\u2026 Sherin and Lodgen\u2019s Bogin-Farber said she\u2019s keeping some takeaways from the court\u2019s ruling in favor of a former high school cheerleader who posted herself cursing on social media after she failed to make the varsity squad and was suspended from the team, even though the decision didn\u2019t stem from an employment case.<\/p>\n<p>While the ruling in\u00a0<a class=\"lexis-referral\" href=\"https:\/\/advance.lexis.com\/api\/search?q=2021%20U.S.%20LEXIS%203395&amp;qlang=bool&amp;origination=law360&amp;internalOrigination=article_id%3D1399612%3Bcitation%3D2021%20U.S.%20LEXIS%203395&amp;originationDetail=headline%3D3%20Discrimination%20Takeaways%20From%20The%20Latest%20High%20Court%20Term&amp;\" target=\"_blank\" rel=\"2021 3395 LEXIS U.S. noopener\">Mahanoy Area School District v. B.L<\/a>. applied to a student and school district, not an employee and employer, Bogin-Farber \u2014 who represents employees \u2014 said that First Amendment concepts can have \u201cbroad applicability\u201d and that she could splice them into an employment context.<\/p>\n<p><strong><a href=\"https:\/\/www.law360.com\/employment-authority\/articles\/1396825\/justices-say-discipline-of-cheerleader-violated-free-speech\">In its June 23 decision<\/a><\/strong>, the Supreme Court found that the cheerleader was allowed to exercise her First Amendment right to free speech outside of school property. Schools have \u2018diminished\u2019 authority to hold sway over what students do off campus, the justices said, but the majority fell short of holding that schools lack authority to regulate all off-campus speech.<\/p>\n<p>Some courts cite a range of cases dealing with First Amendment issues<em>,\u00a0<\/em>which Bogin-Farber said helps her cause since the cheerleader wasn\u2019t an employee, though the attorney<strong>\u00a0<\/strong>admitted employers would likely argue that a case about a student doesn\u2019t apply in an employment context.<\/p>\n<p>\u2018We can at least use the court\u2019s arguments to argue that an employee\u2019s interest is greater if the speech is occurring out of the work environment. Because otherwise, employees, students, et cetera, are under regulation 24\/7, 365 days a year,\u2019 Bogin-Farber said.<\/p>\n<p>She also said her interest was piqued by the court saying the school had an interest in protecting free speech because it actually teaches students about free speech itself \u2014 \u2018America\u2019s public schools are the nurseries of democracy,\u2019 as Justice Stephen Breyer wrote in the majority opinion. That\u2019s an argument Bogin-Farber said she took note of for cases in which she represents teachers.<\/p>\n<p>\u2018Schools are supposed to be teaching by example,\u2019 she said.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gavriela M.
