Daniel S. Guenther quoted in Massachusetts Lawyers Weekly on Boston realtor sued for trespassing
Daniel S. Guenther, partner in the Litigation Department, was quoted in a Massachusetts Lawyers Weekly article titled, “Judge: Gun-toting homeowner can sue realtor for trespass.”
This article covers a 2021 incident in which a real estate broker and prospective buyer entered a house in Milford for a showing, and were subsequently held at gun point by the homeowner, who thought his house was being broken into.

Boston attorney Daniel S. Guenther describes the contribution statute as an “enigmatic” law.
“It’s pretty simple in its words but difficult in its application,” says Guenther, who represents clients in real estate matters as part of his business litigation practice at Sherin & Lodgen.
In agreeing with Kobick’s decision, Guenther says “it’s definitely right at the motion-to-dismiss stage [to conclude] that, if both sets of parties each committed a tort and it was a joint tort, the contribution statute would apply.”
