{"id":14,"date":"2014-11-24T14:23:00","date_gmt":"2014-11-24T14:23:00","guid":{"rendered":"https:\/\/www.sherin.com\/professional-liability\/2014\/11\/24\/dont-be-like-that-guy-first-circuit-says-enough-is-enough-and-upholds-pulled-pro-hac\/"},"modified":"2021-09-22T17:58:00","modified_gmt":"2021-09-22T17:58:00","slug":"dont-be-like-that-guy-first-circuit-says-enough-is-enough-and-upholds-pulled-pro-hac","status":"publish","type":"post","link":"https:\/\/www.sherin.com\/law-firm-defense\/2014\/11\/24\/dont-be-like-that-guy-first-circuit-says-enough-is-enough-and-upholds-pulled-pro-hac\/","title":{"rendered":"Don\u2019t Be Like That Guy: First Circuit Says Enough is Enough and Upholds Pulled Pro Hac"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" id=\"img-1416839217772\" class=\"alignRight\" style=\"float: right; height: 203px; width: 303px;\" src=\"\/wp-content\/uploads\/sh_images\/images\/20517365_m.jpg\" alt=\"Passing Notes\" width=\"304\" height=\"203\" border=\"0\" \/><\/p>\n<p>The First Circuit Court of Appeals has put out-of-town-lawyers with a taste for deposition shenanigans on notice by upholding the District Court\u2019s decision to revoke a California lawyer\u2019s<em>pro hac vice<\/em>\u00a0admission.\u00a0 The District Court had found that attorney Jeffrey Ryan slipped a note to his client while she was \u201cfumbling\u201d for an answer, lied about it to the court, and manufactured evidence to support his lie. Without setting any precise procedural or substantive standards for the revocation of a\u00a0<em>pro hac vice<\/em>\u00a0admission, the First Circuit held that Ryan\u2019s conduct warranted revocation, and affirmed the award of monetary sanctions against him.<\/p>\n<p>The lesson for lawyers is quite simple: \u201cDon\u2019t be like that guy.\u201d<\/p>\n<p><!--more--><\/p>\n<p>In a November 14 <span style=\"text-decoration: underline; color: #0000ff;\"><a href=\"http:\/\/media.ca1.uscourts.gov\/pdf.opinions\/13-2251P-01A.pdf\"><span style=\"color: #0000ff; text-decoration: underline;\">ruling<\/span><\/a><\/span> authored by Circuit Judge William J. Kayatta, the First Circuit concluded that &#8220;[w]ith notice, an opportunity to be heard, and ample, very convincing evidentiary support, the district court found that Ryan falsified evidence and lied point blank with premeditation to the court.\u00a0 Rejecting no procedure timely requested by Ryan or required by due process, and after further notice and opportunity to be heard, the court decided to withdraw its permission that Ryan could appear as counsel in this case.\u00a0 Anyone who thinks it important that lawyers not lie to judges would be surprised if the court had done otherwise.\u201d \u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/media.ca1.uscourts.gov\/pdf.opinions\/13-2251P-01A.pdf\"><span style=\"color: #0000ff; text-decoration: underline;\">Ryan v. Astra Tech, Inc., No. 13-2251<\/span><\/a><\/span><\/span>, 2014 WL 6090701 (1st Cir. Nov. 14, 2014).<\/p>\n<p>The <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/scholar.google.com\/scholar_case?case=10541381810520821754&amp;q=siupa+v.+astra+tech&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\"><span style=\"color: #0000ff; text-decoration: underline;\">story began on the morning of October 24, 2012<\/span><\/a><\/span><\/span> when defense counsel tried to depose Mr. Ryan\u2019s client, the plaintiff in a sexual discrimination case.\u00a0 Defense counsel stated on the record, \u201cI would like the record to reflect Mr. Ryan is writing notes to his client while she is answering a question.\u00a0 If he wishes to prove that\u2019s not true rather going on a rampage, he can turn back over the notepad that he just turned over, and he can show us what he wrote on it.\u201d \u00a0Mr. Ryan responded \u201cNothing that [defense counsel] said in that last statement was accurate. \u00a0100 percent false.\u201d<\/p>\n<p>Things went further downhill that afternoon before then-Magistrate Judge Leo T. Sorokin in District Court.\u00a0 Mr. Ryan said he was \u201cshocked and appalled\u201d about the allegation, and he showed the Court a notepad containing only the courthouse address, stating that was the notepad in question.\u00a0 He also responded (falsely) that defense counsel never asked to see the legal pad, claiming \u201cAll [she] had to do was ask.\u00a0 I\u2019d have handed it to her.\u201d<\/p>\n<p>Mr. Ryan must have forgotten that his statements at the deposition were transcribed.\u00a0 \u201cUnfortunately for Mr. Ryan,\u201d Judge Sorokin <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/scholar.google.com\/scholar_case?case=10541381810520821754&amp;q=siupa+v.+astra+tech&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\"><span style=\"color: #0000ff; text-decoration: underline;\">wrote in a ruling on October 31, 2012<\/span><\/a><\/span><\/span>, \u201cthe record establishes that defense counsel did ask.\u201d\u00a0 Judge Sorokin also heard from the court reporter, who testified that, while she could not read the note that Mr. Ryan flashed to his client, it contained text different from the page he eventually showed the Court.<\/p>\n<p>Judge Sorokin\u2019s October 31 ruling detailed a laundry list of prior chicanery by Mr. Ryan, including insulting correspondence<em>, ad hominem<\/em> attacks on counsel and witnesses, serving discovery in violation of a court order, and filing an amended complaint different from the one he was given leave to file. \u00a0The ruling ordered Mr. Ryan to pay his opponent\u2019s costs, and to show cause why he should not have his <em>pro hac vice<\/em> admission withdrawn.\u00a0 Judge Sorokin subsequently ordered that the <em>pro hac vice<\/em> admission be withdrawn, in a <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/scholar.google.com\/scholar_case?case=15898166118230472606&amp;q=siupa+v.+astra+tech&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\"><span style=\"color: #0000ff; text-decoration: underline;\">written decision on December 18, 2012<\/span><\/a><\/span><\/span>, observing that \u201cthe First Circuit has set no guidelines for resolving such questions in this jurisdiction.\u201d\u00a0 Judge Sorokin found that Mr. Ryan had committed \u201cflagrant ethical violations,\u201d and violated Mass. R. Prof. C., 3.3(a)(1), (4); 3.4(a), (b); and 4.1(a) \u201cby lying to opposing counsel, misrepresenting facts to the Court, and knowingly offering falsified evidence (i.e., the notepad) during an evidentiary hearing.\u201d Judge Sorokin then <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/scholar.google.com\/scholar_case?case=6938800482217206732&amp;q=siupa+v.+astra+tech&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\"><span style=\"color: #0000ff; text-decoration: underline;\">denied a motion for reconsideration on February 5, 2013<\/span><\/a><\/span><\/span>.<\/p>\n<p>The First Circuit rejected a handful of Mr. Ryan\u2019s arguments, including a claim that the revocation of his <em>pro hac vice<\/em> admission violated his right to procedural due process under the Fifth Amendment.\u00a0 \u201cTo the extent due process required prior notice and an opportunity to be heard, those requirements \u2026 were satisfied by the October 31 order to show cause and the opportunities to file several written responses in the district court.\u201d\u00a0 The Court also declined to decide whether the district court should have used a \u201cclear and convincing\u201d evidence standard, or a \u201cpreponderance\u201d standard.\u00a0\u00a0 \u201cWe need not decide today whether the court should have used an elevated standard of proof because there was clear and convincing evidence to support the court\u2019s findings of Mr. Ryan\u2019s conduct.\u201d<\/p>\n<p>The First Circuit weighed the totality of Mr. Ryan\u2019s conduct, and found that even before the fateful deposition, \u201che had already staked out a position at the corner-cutting end of the spectrum.\u201d\u00a0 The Court observed that lawyers should not \u201cconfuse the combative aggressiveness manifest in much of Ryan\u2019s behavior with the professional resolve of an effective advocate.\u201d<\/p>\n<p>Mr. Ryan certainly didn\u2019t do his client any favors; <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a href=\"http:\/\/scholar.google.com\/scholar_case?case=7440347616453794951&amp;q=siupa+v.+astra+tech&amp;hl=en&amp;as_sdt=40000006&amp;as_vis=1\"><span style=\"color: #0000ff; text-decoration: underline;\">she ultimately lost on summary judgment<\/span><\/a><\/span><\/span>.<\/p>\n<p>So remember, \u201ccombative aggressiveness\u201d does not make you an \u201ceffective advocate.\u201d\u00a0 And don\u2019t be like that guy.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The First Circuit Court of Appeals has put out-of-town-lawyers with a taste for deposition shenanigans on notice by upholding the District Court\u2019s decision to revoke a California lawyer\u2019spro hac vice\u00a0admission.\u00a0 The District Court had found that attorney Jeffrey Ryan slipped a note to his client while she was \u201cfumbling\u201d for an answer, lied about it [&hellip;]<\/p>\n","protected":false},"author":9,"featured_media":70,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":"","_links_to":"","_links_to_target":""},"categories":[],"tags":[],"class_list":["post-14","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
