Negotiation of development agreement and ground lease
- Peter Friedenberg and Andrew Royce represented MassDOT in the negotiation of a Development Agreement and a long-term Ground Lease and related documents (including a lease of a portion of the site from the MBTA) for the construction by a national developer of a $190 million mixed-use complex including 310 apartment units, retail space, and a 147-space parking garage.
- Representation also included review on behalf of MassDOT of the developer’s due diligence materials, reviewing title and survey matters, coordinating with separate outside counsel for the MBTA on all project matters, coordinating with the developer on permitting matters and other pre-construction issues.
