{"id":5652,"date":"2023-06-09T15:00:19","date_gmt":"2023-06-09T15:00:19","guid":{"rendered":"https:\/\/www.sherin.com\/real-estate\/?p=5652"},"modified":"2023-06-09T15:21:38","modified_gmt":"2023-06-09T15:21:38","slug":"massachusetts-sjc-rules-in-favor-of-hume-lake-christian-camp-zoning-appeal-under-the-dover-amendment","status":"publish","type":"post","link":"https:\/\/www.sherin.com\/real-estate\/2023\/06\/09\/massachusetts-sjc-rules-in-favor-of-hume-lake-christian-camp-zoning-appeal-under-the-dover-amendment\/","title":{"rendered":"Massachusetts SJC rules in favor of Hume Lake Christian Camp zoning appeal under the Dover Amendment"},"content":{"rendered":"<p>The Supreme Judicial Court finds that Hume Lake Christian Camps, Inc.\u2019s proposed recreational vehicle park would be exempt from Monterey\u2019s bylaws under the <a href=\"https:\/\/malegislature.gov\/Laws\/GeneralLaws\/PartI\/TitleVII\/Chapter40A\/Section3\" target=\"_blank\" rel=\"noopener\">Dover Amendment<\/a>, G.L.c. 40A, \u00a73, due to its religious purpose.\u00a0 The court finds that \u201cthe use of land or structure can serve a religious purpose without itself being a form of religious practice.\u201d<\/p>\n<p>Hume acquired the Hume New England campground in 2012, where they run \u201cprogram camps\u201d and \u201cguest retreats\u201d with the purpose of furthering their religious mission. \u00a0In May 2019, Hume submitted to the Planning Board of Monterey an application for the construction of an RV camp on Hume NE\u2019s grounds. \u00a0These sites would be located within walking distance of the other facilities, in order to accommodate \u201ctemporary travel trailers, motorhomes, tents, and seasonal staff housing trailers.\u201d The RVs were to be used for families, volunteers, and seasonal, temporary staff during the summer months.<\/p>\n<p>Under Monterey\u2019s zoning bylaws, the principal use of a \u201ctrailer or mobile home park\u201d is prohibited in all zoning districts. In July 2019, the board denied Hume\u2019s application to construct the RV camp on the grounds that the trailer park is not customary religious use and should not fall under the umbrella of the Dover Amendment. \u00a0Hume appealed.<\/p>\n<p>The court looked to whether Hume\u2019s proposed construction of an RV camp at Hume NE would be exempt from the zoning by law pursuant to the Dover Amendment.<\/p>\n<p>When deciding if this use falls under the Dover Amendment, the court looked to \u201cwhether [the land] or structure as a whole is to be used for religious purposes\u201d. The religious purpose exemption covers any use the primary or dominant purpose of which is to \u201caid a system of faith\u201d. \u201cThe court emphasized that the religious purposes exemption does not require that a proposed use be intrinsically religious in order to serve a religious purpose.\u201d The court found while the RV park is not intrinsically religious, the court has taken the broad view that the RV park facilitates the religious purpose of Hume NE camp by house the families and staff that attend and operate the religious camp.<\/p>\n<p>The court concluded that the RV camp\u2019s dominant purpose was a religiously significant goal and would be exempt under the Dover Amendment.
