Peter Friedenberg discusses the SJC's decision in Bishop v. TES Realty Trust and the impact it will have on commercial landlords. The court ruled that that a landlord who receives written notice from a tenant of an unsafe condition within the demised premises has a statutory duty to correct the condition within a reasonable time. If it does not, any person (not just the tenant) who is injured by that condition can sue the landlord.
