“Massachusetts-based worker-side attorney Gavriela Bogin-Farber of Sherin and Lodgen LLP highlighted a federal judge’s Nov. 10 ruling denying a preliminary injunction to the employees. The case involves workers who wanted both religious and medical exemptions to the mandate, which the hospital had denied and which he analyzed separately, she said.

U.S. District Judge F. Dennis Saylor IV went in-depth analyzing the hospital’s response and the workers’ medical claims under the Americans with Disabilities Act, she said.

The judge found that the hospital system ‘had full legal support in denying these requests for accommodation,’ Bogin-Farber said. ‘On the disability front, part of it was that none of the medical conditions that the plaintiffs raised as disabilities have been recognized by the medical community as contraindications for the vaccine,’ Bogin-Farber said.”
