David I. Brody quoted in Massachusetts Lawyers Weekly on new DOL joint employer rule
David I. Brody, partner in the firm’s Employment Department, was quoted in a Massachusetts Lawyers Weekly article on May 3. The article, titled “New DOL joint employer rule sparks split among attorneys,” discusses how in April, the U.S. Department of Labor proposed a rule to clarify joint employer status under the Fair Labor Standards Act, Family and Medical Leave, and Migrant and Seasonal Agricultural Worker Protection Act.

“…Boston plaintiffs’ employment attorney David I. Brody said news of the DOL’s proposed rule was another moment at which he found himself grateful to be working in Massachusetts, where state laws are friendlier to employees.
“What this does is, it yet again moves the goalposts under the FLSA to make it harder for employees to be compensated fairly for their work,” he said.
Brody added that, in Massachusetts, the impact of the proposed changes would fall disproportionately on employees who are exempt from either the Wage Act or the state’s overtime statute, like hospital workers.
