Nancy S. Shilepsky, partner in the firm’s Employment Department, and Brian J. MacDonough, chair of the department, were published in Law360 on March 29, 2021. Their article, “Religious School Worker Anti-Bias Battle Isn’t Over Yet,” addresses recent developments in how the exception doctrine is applied to employment discrimination cases involving religious schools. For instance, in Our Lady of Guadalupe School v. Morrissey-Berru, the Supreme Court held that teachers in the Roman Catholic elementary school could not avail themselves of the laws against employment discrimination because they fell within the ministerial exception.
