Brian J. MacDonough chairs the MCLE program, “Roadmap to the ADA Interactive Process”

Partner and Employment Department Chair Brian J. MacDonough chaired the Massachusetts Continuing Legal Education (MCLE) program, “Roadmap to the ADA Interactive Process,” on May 5. Brian presented the sessions, “Interplay between the ADA and Other State/Federal Leave Laws,” “What is Considered a “Reasonable” Accommodation?,” and “Accommodations for Mental Health Issues.” Presenters shared insights on how employment lawyers must advise clients about medical leave, remote work, and workplace redesign in the context of determining the rights of employees with disabilities seeking accommodations.

The program covered the interactive process under the Americans with Disabilities Act (ADA) and parallel state law, complicated by the evolving workplace layered on top of new leave statutes and the post-pandemic work environment.

As Chair of the Employment Department, Brian handles a wide range of complex employment matters, advising executives and professionals regarding terms of employment, equity and deferred compensation, non-competition and other restrictive covenants, and terms of separation and transition. He has particular expertise in cross-border matters and is a trusted advisor to his global executive clients. In addition to his executive advocacy practice, Brian also litigates cases in both federal and state courts and appears regularly before state and federal agencies, including the Massachusetts Commission Against Discrimination and U.S. Equal Employment Opportunity Commission. He is a former co-chair of the Boston Bar Association’s Labor & Employment Law Section.

The program will be rebroadcast on Wednesday, May 20 at 9:00 a.m. and Thursday, May 28 at 11:00 a.m.
