David I. Brody quoted in Massachusetts Lawyers Weekly on remote work disability accomodations

David  I. Brody, partner in the firm’s Employment Department, was quoted in an article from Massachusetts Lawyers Weekly,  titled, “Remote work disability accommodations fuel legal clashes.” This article explores the increase in return-to-office mandates from employers, as well as disability accommodation requests from employees.

From the article:

Private employers did not need a reminder that they hold the upper hand, said plaintiffs’ side employment attorney David I. Brody.

“An employee does not have a right to work in their pajamas,” Brody said. “If your employer wants to command you back into the office, they’re allowed to do so.”

But an employee also has a right to a reasonable accommodation for a disability or for a sincerely held religious belief, he continued.

“Once an employee is able to establish that they have one of those two things and that they make a request for that reasonable accommodation for, say, remote work or a hybrid working arrangement, the employer doesn’t get to just say ‘no,’” Brody said.
