Matthew Moschella, the chair of the litigation department at Sherin & Lodgen LLP, said having flexibility during trials that can often be dynamic is critical.

“You think you know how long a trial is going to last, and you plan based on that, and then things change, and you need to make modifications during trial,” Moschella said. “I think this ruling highlights the need to think through how you are going to present your case, the most efficient way to present your case, well in advance, and to collaborate with the opposing counsel for a realistic and practical schedule.”
