Partner Jennifer Ioli Connelly chairs the MCLE program, “Drafting & Negotiating Subordination, Non-Disturbance & Attornment Agreements”

Partner Jennifer Ioli Connelly chaired the Massachusetts Continuing Legal Education (MCLE) program, “Drafting & Negotiating Subordination, Non-Disturbance & Attornment Agreements,” on April 6. Jen and fellow faculty discussed the fundamental issues associated with subordination, non-disturbance & attornment agreements (SNDAs), and how they are resolved by lenders, tenants, property owners/landlords, and, if litigation ensues, the courts. They also addressed why SNDAs are necessary, goals for other parties to the SNDA, which form of SNDA the parties use, traps for the unwary, practical solutions to resolve common issues in negotiating, the legal consequences of not having an SNDA, and tips when representing each party to an SNDA.

Jen is a partner in the Sherin’s Real Estate Department and Renewable Energy Practice Group. As a commercial real estate attorney, she represents retailers, developers, and institutions on all aspects of commercial real estate transactions, including acquisitions, development, leasing, and financing. Jen also advises institutional investors, industrial companies, and other types of commercial property owners on solar leasing matters for rooftop, ground mounted, and canopy facilities.

The program will be rebroadcast on Tuesday, April 21 at 12:00 p.m. and Wednesday, April 29 at 2:00 p.m.
