Thomas F. Maffei quoted in Massachusetts Lawyers Weekly

Thomas F. Maffei, of counsel in the firm’s Litigation Department, was quoted in Massachusetts Lawyers Weekly article, “Attorneys take ‘rare’ step, disavow client’s testimony,” on January 10, 2019.  The article addresses Rule 3.3 of the Rules of Professional Conduct in the case of Department of Early Education and Care v. Strawberry Child Care.

Boston attorney Thomas F. Maffei said the rule attempts to provide guidance in circumstances in which attorneys must perform a “balancing act” between their conflicting duties of confidentiality and candor.

The rule has been interpreted as instructing attorneys to take an “incremental approach” to disclosure, he added.

“You don’t immediately go rat out your client,” Maffei said.
