Commercial Leases and Frustration of Purpose, Impossibility Defenses: Strategies for Landlords and Tenants

By Sherin and Lodgen on April 23, 2021

Joshua M. Bowman, chair of the firm’s Hospitality Practice Group, served as a panelist at Strafford Publication’s April 15th webinar, “Commercial Leases and Frustration of Purpose, Impossibility Defenses: Strategies for Landlords and Tenants.” The CLE webinar guides landlord and tenant counsel on the defenses that have arisen in breach of lease cases due to failure to pay rent during the COVID-19 pandemic. The panel addresses recent cases from New York, Texas, California, Massachusetts, and New Jersey to establish how courts have analyzed claims of the frustration of purpose, impossibility, and other common law defenses.
