Christopher R. Blazejewski quoted in Massachusetts Lawyers Weekly on lawyer confidentiality recommendations
Christopher R. Blazejewski, partner in the firm’s Litigation Department, was quoted in a Massachusetts Lawyers Weekly article titled, “ABA opinion stresses confidentiality in withdrawals.” This article discusses the new American Bar Association Opinion 319, that reinforces lawyers’ requirement to maintain confidentiality of cases they are withdrawing from, and also may develop consistency in the way that judges manage motions to withdraw.

“The practical reality is stark: Under the ABA opinion, unless the client consents, the court orders disclosure, or another specific exception applies, a lawyer must protect client confidences even if it means remaining stuck in a representation the lawyer is ethically required to leave,” Blazejewski said. “Lawyers may find unsettling the ABA opinion’s conclusion that, if caught in this bind, they should continue the impermissible representation as the lesser of two evils.”
